THE AFTERMATH OF LOWELL`s Criminal Appeal

IMPERIUM EUROPA New Right Leader NORMAN LOWELL with his assiduous legal Counsel EMMY BEZZINA outside the Courts of Justice Main Entrance on Tuesday, April 8th, 2008, at 0930hrs.,immediately following the filing of the Criminal Appeal before the Court of Criminal Appeal.

In accordance with the Criminal Law [ Chapter 9 of the Laws of Malta ] , Accused found guilty by the Magistrates` Court has eight working days to appeal from that Judgement. Lowell was found guilty by the Magistrates` Court on Thursday, March 27th, 2008. His legal Appeal time expired on Wednesday, April 9th and Lowell appealed with twenty-four hours to go. A number of interested observers were hoping that Lowell would be only all words but would not in fact appeal the 117-Page Inferior Court Judgement by Magistrate Dr. Consuelo-Pilar Scerri Herrera, LL.D.

Lowell and his Legal Counsel had other ideas. Their Reply came in the form of a 64-Page Appeal,all original, legally tailored within the strict confines of the three basic regulations that have to be scrupulously followed in Criminal Appeals, culminating in 23 Requests, the first 14 of which plea for the revocation of the Judgement on the principles that it is null and void, ineffective and non-enforceable for various factual and legal reasons; the last nine for the alteration and modification of the March 27th Judgement equally on various legal and factual submissions.The Appeal has yet to be appointed .

Much has been reported in the Media about this Appeal. Attempts are being made to influence the Court of Criminal Appeal with several camouflaged or hidden messages . Lowell and his Counsel have repeatedly asserted that while they have complete confidence in the Criminal Appeals Court , they do not exclude the possibility of requesting reference to the Constitutional Court. This is a Case where the four basic freedoms of communication are being challenged: those of Opinion, Thought, Expression , and Form of Communication.


Hopefully, Justice will be seen to be done.
